1) Who we are and what these Terms cover
These Terms of Service (“Terms”) are a legal agreement between you and [JustSell] (“we”, “us”, “our”), and they govern your access to and use of the Service.
The Service provides tools that help merchants create storefronts and accept crypto payments and/or Telegram Stars from buyers.
By using the Service, you agree to these Terms and our Privacy Policy.
2) Definitions (simple)
- Merchant: a user who creates or manages a storefront and sells goods/services.
- Buyer: a user who purchases from a merchant storefront.
- Content: anything uploaded or published through the Service (e.g., listings, descriptions, images, files, messages).
- Wallet: a third‑party crypto wallet (including via WalletConnect) you use to sign in or pay.
3) Eligibility
You must be 18 years or older to use the Service.
You are responsible for ensuring your use of the Service is legal where you live and where you operate.
4) Accounts, login methods, and security
You may sign in using:
- WalletConnect / wallet login
- Email + password
- Telegram Login Widget
- Telegram Mini App
You agree to provide accurate information when creating an account (where applicable) and to keep your account secure.
Optional 2FA
We offer optional two‑factor authentication (2FA). If you enable it, you are responsible for keeping your 2FA method secure. Losing access may limit your ability to access your account.
No KYC
We do not require identity verification (“KYC”) to use the Service.
5) What we are (and are not)
We are a tool, not the seller
Merchants are responsible for:
- what they sell,
- what they promise,
- fulfillment and delivery,
- refunds and customer support,
- and compliance with laws (including consumer protection, taxes, and any rules applicable to their business).
When a Buyer purchases from a Merchant, the purchase is between the Buyer and the Merchant. We are not a party to that sale.
Non‑custodial design
The Service is built to be non‑custodial. We do not hold your private keys.
For crypto checkouts, payments are intended to be automatically forwarded to the Merchant’s wallet upon receipt based on the checkout instructions shown to the Buyer.
6) Payments and transaction risks
Supported payment rails
The Service may support payments on networks including:
- Ethereum (ETH)
- Solana (SOL)
- BNB Chain (BNB)
- Polygon (POL)
- Bitcoin (BTC)
- Litecoin (LTC)
- Monero (XMR)
- and EVM tokens (e.g., USDT / USDC / DAI) where supported by the checkout.
Supported networks/tokens may change over time as we update the Service.
Important blockchain realities
You agree and understand:
- Blockchain transactions can be irreversible.
- If you send funds to the wrong address, on the wrong network, or with unsupported token formats, recovery may be impossible.
- Network fees, congestion, chain reorganizations, outages, wallet bugs, and third‑party issues are outside our control.
Telegram Stars
If you pay using Telegram Stars, the payment is processed through Telegram’s systems. Merchants receive Stars through their own bot / Telegram setup (as applicable). Telegram’s terms and policies also apply.
7) Fees (if any)
Some features may be paid (e.g., subscriptions or transaction fees). If we charge fees:
- we will show pricing in the Service or on our website before you pay,
- fees are generally non‑refundable unless required by law or explicitly stated otherwise.
8) Prohibited use (keep it clean)
You may not use the Service to:
- break any law or regulation,
- sell illegal goods/services, stolen data, hacked accounts, malware, phishing, scams, or fraud,
- facilitate money laundering, sanctions evasion, or financing illegal activity,
- harass, exploit, or harm others,
- upload content that infringes intellectual property rights,
- interfere with, exploit, or reverse engineer the Service,
- scrape the Service or abuse our infrastructure.
We may remove content or restrict accounts that violate these rules.
9) Merchant content and responsibilities
Merchants are solely responsible for their listings and content, including legality, accuracy, and fulfillment.
We may remove or limit content that violates these Terms or creates risk for users or the Service.
10) Third‑party services
The Service integrates with third‑party services (for example: Telegram, WalletConnect, wallet providers, blockchains, nodes, hosting/CDN providers).
We don’t control third parties and aren’t responsible for their downtime, security, policies, or actions.
11) Suspension and termination
We may suspend or terminate access to the Service if:
- you violate these Terms,
- we believe your activity is harmful, abusive, fraudulent, or illegal,
- we need to comply with legal obligations,
- to protect the Service and other users.
You may stop using the Service at any time. You can request account deletion as described in the Privacy Policy.
12) Disclaimers
The Service is provided “as is” and “as available.”
We do not guarantee the Service will be uninterrupted, secure, or error‑free.
We do not guarantee any outcomes from using the Service, including sales, conversion, delivery success, or payment finality (which depends on third‑party networks).
13) Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
14) Indemnity
If you are a Merchant, you agree to defend and indemnify us from claims arising out of:
- your storefront, listings, sales, fulfillment, refunds, and customer disputes,
- your content,
- your violation of these Terms or the law.
15) Changes to these Terms
We may update these Terms from time to time. If we make changes, we’ll update the “Last updated” date. Continuing to use the Service after changes means you accept the updated Terms.
